Location-Based Service Terms of Use

Article 1 (Purpose)

The purpose of these Terms is to establish the basic matters such as the conditions and procedures for use, and the rights, obligations, and responsibilities of Future Value 21 (hereinafter referred to as "Jayu Promotion") and individual location information subjects (hereinafter referred to as "Users") when using the location-based services (hereinafter referred to as the "Service") operated and provided by Jayu Promotion.



Article 2 (Effect and Modification of Terms of Use)

1. These Terms become effective when a user who applies for the Service agrees to these Terms and registers as a user of the Service through the procedures established by Jayu Promotion.

2. If a user clicks the "Agree" button for these Terms online or agrees through any other method, the user is deemed to have read, fully understood, and agreed to all contents of these Terms.

3. Jayu Promotion may modify these Terms if it determines that there are important reasons requiring changes due to the application of new services, compliance with government corrective orders, or other business-related reasons.

4. If the Service contracted with a user is changed due to reasons such as technical specification changes, Jayu Promotion shall immediately notify the user through an available method.

5. When changing these Terms, Jayu Promotion shall announce the revised Terms and reasons for the changes on the Service website or notify users electronically (email, SMS, etc.) at least one week before the effective date. If the user does not object within this period or continues to use the Service, the user shall be deemed to have agreed to the changes.



Article 3 (Other Applicable Rules)

Matters not specified in these Terms shall be governed by relevant laws and regulations, including the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, Jayu Promotion's Terms of Use, Privacy Policy, and separately established guidelines.



Article 4 (Application for Use and Formation of Contract)

1. These Terms become effective when the user agrees to these Terms and registers as a user of the Service through the procedures established by Jayu Promotion.

2. The service agreement is established when the user agrees and Jayu Promotion accepts the application.

3. If the user clicks the "Agree" button online or agrees through any other method, the user is deemed to have read, fully understood, and agreed to these Terms.

4. Jayu Promotion may request submission of related documents for user verification.

5. If the user does not agree to these Terms, use of the Service may be restricted.

6. Jayu Promotion may modify these Terms when necessary due to new service applications, government corrective orders, or other important business reasons.



Article 5 (User ID)

1. User IDs that can access location information shall generally be limited to one account per person.

2. A user ID may be changed upon the user's request in the following cases:

a. When the user ID has been exposed to another person

b. When there is another reasonable reason

3. The user is responsible for managing their user ID and shall be responsible for accidents except where disclosure occurred due to Jayu Promotion's intentional actions.

4. If the user ID is leaked and there is a risk of damage, the user must report it to Jayu Promotion and change the user ID. Jayu Promotion shall immediately stop service use through the previous user ID.



Article 6 (Methods of Collecting Location Information)

Jayu Promotion collects users' personal location information through the following methods:

1. Real-time location information collection based on mobile communication base stations (Cell ID method)

2. Location information collection through GPS information collected from dedicated devices equipped with GPS chips

3. Location information collection through Wi-Fi information collected from dedicated devices equipped with Wi-Fi chips



Article 7 (Service Content)

Jayu Promotion provides services using location information and status information received from location information providers as follows:

1. Service Name: Jayu Promotion

2. Service Content: Delivery Service

a. Real-time location tracking of delivery-related targets

b. Providing real-time delivery information and store information based on the user's location



Article 8 (Service Fees)

Data communication charges incurred when using wireless services for the Service are separate and follow the policies of each user's mobile carrier. These are communication costs paid by the user for using Jayu Promotion's Service. No additional fees are charged for providing location-based information other than communication fees paid to the mobile carrier.



Article 9 (Use or Provision of Personal Location Information)

When Jayu Promotion intends to use personal location information to provide services, it must specify the following matters in the Terms of Use and obtain consent from the personal location information subject in advance.

1. Jayu Promotion shall display its company name, address, phone number, and other contact information on the Service screen so that users can easily access them, and shall provide access to these Terms through a linked page.

2. The rights of users and legal representatives and the method of exercising such rights shall be governed by the district court having jurisdiction over the user's address at the time of filing. If there is no address, the court having jurisdiction over the user's residence shall apply. However, if the user's address or residence is unclear at the time of filing or the user resides overseas, the court prescribed under the Civil Procedure Act shall have jurisdiction.

3. If personal location information is provided to a third party designated by the user, Jayu Promotion shall notify the user of the recipient and purpose of provision and obtain prior consent. Notification may be provided through the user's previously designated email or online posting methods in the following cases:

a. When the communication terminal device collecting personal location information does not have text, voice, or video receiving functions

b. When the user has requested notification through online posting methods in advance



Article 10 (Purpose and Retention Period of Personal Location Information)

Jayu Promotion retains personal location information as follows for providing location-based services.

1. Personal location information shall be destroyed without delay once the purpose of providing and using location-based services under Article 7 has been achieved.

2. However, for services where location information is stored together with user-created posts or content, such information may be retained during the storage period of the relevant posts or content.

3. If necessary for providing location-based services, personal location information may be retained for the minimum period necessary to achieve the purpose of use.

4. Notwithstanding Paragraphs 1, 2, and 3, if retention is required by other laws or the Location Information Protection Act, such requirements shall apply.



Article 11 (Rights of Personal Location Information Subjects)

1. Users may reserve all or part of their consent regarding the use and provision of location-based services using personal location information at any time.

2. Users may withdraw all or part of their consent regarding the use and provision of location-based services using personal location information at any time. Jayu Promotion shall not refuse such requests and shall take necessary technical measures.

3. Users may request access to or notification of the following information from Jayu Promotion and may request correction if errors exist:

a. Records confirming the collection, use, and provision of the user's location information

b. Reasons and details for providing the user's personal location information to third parties under the Location Information Protection Act or other laws

4. If a user withdraws all or part of consent, Jayu Promotion shall immediately destroy personal location information and records confirming the use and provision of location information.

5. Users may exercise the rights under Paragraphs 1 through 3 through Jayu Promotion's established procedures.



Article 12 (Rights of Legal Representatives)

1. Jayu Promotion does not allow users under the age of 14 to register or use the Service.



Article 13 (Obligations of Jayu Promotion)

1. Jayu Promotion shall appoint and operate a person responsible for location information management who has actual responsibility for properly managing and protecting location information and smoothly handling complaints from personal location information subjects.

2. The location information manager shall be the head of the department providing location-based services, and specific details shall be provided in the supplementary provisions of these Terms.

3. Jayu Promotion shall not disclose or distribute users' location information or registered information obtained in connection with providing the Service to third parties without prior consent, except when required by investigative authorities under relevant laws or requested by the Korea Communications Standards Commission.



Article 14 (Scope of Damages)

1. A personal location information subject may claim damages from Jayu Promotion if they suffer damages due to violations of Articles 15 through 26 of the Location Information Protection Act. Jayu Promotion shall be liable unless it proves no intentional or negligent conduct.

2. Jayu Promotion shall not be liable for damages caused by force majeure such as natural disasters or by the user's intentional or negligent actions.

3. Jayu Promotion shall not be liable for damages caused by inaccurate location information due to mobile network conditions.

4. If a user causes damage to Jayu Promotion by violating these Terms, Jayu Promotion may claim damages against the user.

5. Claims for damages must be submitted in writing stating the reason, amount, and calculation basis.



Article 15 (Disclaimer)

1. Jayu Promotion shall not be responsible for damages caused when the Service cannot be provided due to:

a. Natural disasters or equivalent force majeure

b. Intentional service disruption by third parties contracted with Jayu Promotion

c. Service failures caused by the user's responsibility

d. Other reasons without Jayu Promotion's intent or negligence

2. Jayu Promotion does not guarantee the reliability, accuracy, or completeness of information and materials provided through the Service and shall not be liable for damages arising from them.

3. If the Service cannot be started due to technical or operational problems, Jayu Promotion shall notify users through the Service screen or email. If prior notice is impossible due to uncontrollable circumstances, notice shall be provided afterward.



Article 16 (Application of Regulations)

1. These Terms shall be governed and interpreted according to the laws of the Republic of Korea.

2. Matters not specified in these Terms shall follow relevant laws and commercial practices.



Article 17 (Dispute Resolution and Other Matters)

1. If a dispute arises between Jayu Promotion and a user regarding the Service, both parties shall sincerely consult to resolve the dispute.

2. If consultation is unsuccessful or impossible, disputes related to location information may be submitted to the Korea Communications Commission or the Personal Information Dispute Mediation Committee according to relevant laws.

3. If the dispute cannot be resolved through the above procedures, either party may file a lawsuit in the competent court under the Civil Procedure Act.

Jayu Promotion (hereinafter referred to as "Future Value 21") establishes and discloses the following Privacy Policy in accordance with Article 30 of the Personal Information Protection Act to protect users' personal information and to ensure that related complaints are handled quickly and smoothly.

Based on Article 16(2) of the Location Information Protection Act, records of location information use and provision are automatically recorded and retained for at least 6 months.

Destruction method

Electronic files are destroyed using unrecoverable methods. Printed materials are shredded or incinerated.

Third-party provision

Jayu Promotion does not provide personal location information to third parties without prior consent.

When providing information to a designated third party, users are immediately notified of:

10. Notification of Privacy Policy Changes

This Privacy Policy applies from the effective date.
